A judge has thrown out the assault case against Thordan Smash, a popular YouTuber and Twitch streamer known for playing Apex Legends.
On May 7, the motion to dismiss the case, in which the content creator was facing charges of 2nd-degree assault and criminal mischief, was approved by Judge David Karpel.
On December 21, 2023, Thordan Smash’s Twitch stream was abruptly interrupted when an officer from the El Paso County Sheriff’s Office entered the room. The reason for the police’s involvement was initially unknown, with some rumors suggesting that the streamer had been targeted by a swatting incident.
Thordan uploaded a video to his YouTube channel, providing an update on the case after his dismissal.
Thordan Smash is a well-known figure in the Apex Legends community, having amassed a following of over 220,000 subscribers on his channel. In addition, he has been actively involved in the esports scene, serving as a manager for GLYTCH Energy and Oxygen Esports. However, in October 2023, he left Oxygen Esports.
After news of his arrest and charges went viral on social media, Thordan took to X/Twitter to address the allegations: “I am aware of the accusations against me and am eager to prove my innocence in the upcoming weeks. Some of you may have already seen the evidence I shared earlier, but my lawyer has advised me to remove it for now. It will be made public in due time.”
“I strongly urge individuals to grasp the notion of being presumed innocent until proven guilty.”

In Colorado, 2nd-degree assault is considered a class 4 felony and, being classified as a violent crime, carries a mandatory sentence of five to 16 years in prison.
The YouTuber was originally charged with a class 2 misdemeanor for Criminal Mischief, which involved causing damage to property valued between $300 and $1000. However, the case has since been dropped.
After being granted bond on Christmas Day, Thordan Smash resumed his activities of uploading YouTube content and streaming on Twitch.
