As the highly publicized legal battle between Fiona Harvey and Netflix progresses, the streaming service has acknowledged that she was never found guilty of stalking Richard Gadd, the creator of Baby Reindeer.
Following the worldwide debut of the Netflix series Baby Reindeer, Fiona Harvey, a 58-year-old woman, was sought out by viewers who believed she was the actual inspiration for the character of Martha. Martha is known for stalking and harassing Donny (played by Gadd) in the series.
Beginning with the statement “This is a true story,”the eight episodes of the show depicted Martha’s conviction for stalking and her subsequent imprisonment in the final episode. This led to Harvey’s appearance on Piers Morgan Uncensored, during which she refuted the events shown on the show and announced her intention to take legal action against Netflix and Gadd.
Harvey stayed true to her word and proceeded to file a claim for a substantial sum of $170 million. The legal case is currently in progress, as Gadd recently submitted a court filing detailing his version of events earlier this week. In a recent development, Netflix has acknowledged that Harvey was never found guilty.
According to Deadline, Netflix confirmed that Harvey had only ever been served a court order, which was also verified in Gadd’s statement.
Benjamin King, Netflix’s senior UK director of public policy, was quoted prior to the trial describing Baby Reindeer as a “true account of the appalling abuse committed by a convicted stalker.”
King clarified in his letter of response that the person on whom the show is based, whom they have not sought to identify, was subject to a court order rather than a conviction.
The author of Baby Reindeer suffered from severe harassment for several months, a situation that appears to be common for many others, causing a considerable toll on his mental and emotional health.
Latham & Watkins, the legal team representing the streaming service, maintains that Harvey’s lawsuit will not succeed as she has not claimed that any false statements of fact were made about her.
According to his statement, Gadd reiterated that Martha is a fictional character and stated that he never intended for the series to depict any real person as Martha Scott, including Harvey.
When Morgan interviewed Harvey in May, he denied being a stalker, having a criminal record, or having any injunctions, stating that it was all untrue.
Since June of this year, Harvey has not made any additional public comments, including on his personal social media channels.
