The Seoul Western District Court’s Criminal Division 4 sentenced individual A to 1 year and 6 months on August 30th for violating the Special Act on the Punishment of Sexual Crimes, specifically for illegal filming and distribution. Due to a potential flight risk, A was taken into custody immediately. Additionally, the court mandated that A complete 40 hours of sexual violence treatment and restricted his employment in institutions related to children or disabled individuals for a period of 3 years.
During the trial in June, the prosecution had requested a sentence of 3 years, highlighting the serious nature of the defendant’s actions and the victims’ claims for stringent penalties.
A’s attorney appealed for leniency, arguing that while the actions were inappropriate, they occurred within the context of a relationship and that there was no intent to distribute the footage. On September 4th, A formally filed an appeal through his lawyer.
The court underscored the point that “the illegal filming of victims’ naked bodies leads to extreme sexual humiliation, and distributing such illegal recordings can cause irreversible harm. Given the gravity of the violation of the victims’ sexual autonomy, the crime is severe.”
Furthermore, the court noted that the defendant committed offenses against three victims, all of whom had been in relationships with him. While A made a financial offer to two of the victims, they declined and continued to seek a harsh sentence. The court acknowledged A’s admission of guilt and reflection on his actions, the fact that the footage had not been distributed, and his lack of prior offenses of this nature.
From July 2022 to May of the previous year, A faced trial for filming his romantic partner, referred to as victim B, 18 times while she was blindfolded, capturing intimate moments and private areas. Investigations revealed that there were three victims in total, including B.
A began his career as part of an idol group in 2017 but discontinued activities in 2019 due to health concerns. The group is currently inactive.
