IVE Wonyoung Fights Back: Lawyer Accuses Prosecution of Media Manipulation in Defamation Case

The third hearing regarding the ongoing legal dispute between Starship Entertainment and the operator of the YouTube channel “Sojang”took place on June 19th at the Seoul Central District Court, marking a significant moment in the case.

The significant attention garnered by the lawsuit, which focuses on defamation damages claims, is due to its potential effects on online content regulation and celebrity rights.

Since November 2022, Starship Entertainment has taken legal actions, both civil and criminal, against the operator identified as A, who manages Jang Wonyoung and other celebrities.

A has been accused of posting 23 defamatory videos targeting seven celebrities and influencers, including Jang Wonyoung, from October 2021 to June 2023.

During the recent hearing, A’s lawyer gave updates on the criminal proceedings against their client, with only legal representatives from both parties in attendance.

“According to the defense counsel, the case has been indicted but a trial date has yet to be set.”

The attorney also raised apprehensions about the authorities’ management of the case, alluding to what they deemed as abnormal promotion and procedural tactics.

“It is unusual for the prosecution to publicize this case to the extent that it feels like disclosing details of the investigation. Initially, the Incheon District Prosecutor’s Office wanted to arrest A and requested a warrant, which was denied. They then combined other cases to reapply for the warrant, but that was also denied. Eventually, A was indicted without detention, raising questions about the fairness and motives behind the legal process” -Lawyer

Starship Entertainment reiterated their dedication to following the legal process in response.

“Starship Entertainment did not submit this separately. The materials distributed by the prosecution can be submitted as evidence.” -Starship Entertainment

The court recognized the intricacy of the matters under consideration, emphasizing the significance of credibility in evaluating the evidence.

“It is a matter of credibility and the key is how to figure it out.”

At the same time, the civil branch of the lawsuit continues to progress separately, with a focus on claims for damages.

The first appellate hearing for Jang Wonyoung’s claim is scheduled for September 4th, marking a crucial point in the ongoing legal battle.

The result of these proceedings has the potential to impact future cases involving online defamation and the obligations of content creators.

Despite the ongoing legal disputes, stakeholders in South Korea’s entertainment and digital media industries are closely monitoring the outcomes and their potential impact on issues such as freedom of expression, celebrity rights, and the governance of online platforms.
