Kick Implements Minor Update Following Pirate Software’s Major Category Concern

Kick has made a modification to one of its categories after the well-known streamer Pirate Software highlighted an issue that has been preventing him from streaming on the platform.

During an October live stream, Pirate Software, who holds the Twitch Hype Train record, discussed the reasons behind his decision not to multi-stream on Kick.

He pointed out that apart from the persistent moderation challenges on the site, Kick seems to permit rampant streaming of copyrighted content. He specifically referenced its ‘Other, Watch Party’ category, which had previously been labeled as ‘Other, TV Shows & Movies.’

During his broadcast, he showcased this category, revealing numerous users streaming copyrighted materials, such as popular television series, anime, and more.

“As a platform, if someone is streaming copyrighted content on your service, you receive a DMCA claim and are expected to take it down,” he stated. “…but if you create a category named ‘Other, TV Shows & Movies,’ you are inadvertently encouraging this behavior on your platform.”

Following this incident, the category’s name was eventually altered after what is believed to be a conversation between Pirate Software and Kick co-founder Trainwreck. However, the URL remained unchanged, and it still appeared as ‘Other, TV Shows & Movies’ in search results.

Kick subsequently directed us to their DMCA Policy and Terms of Service, which detail users’ rights regarding their content and intellectual property.

According to their TOS, Kick states that it “takes no responsibility and assumes no liability for any User Content that you or any other User or third-party posts, sends, or otherwise makes available over the Service.”

Moreover, Kick emphasizes that streamers “shall be solely responsible for your User Content and the consequences of posting, publishing it, sharing it, or otherwise making it available on the Service,” indicating they are merely “acting as a passive conduit for your online distribution and publication of your User Content.”
