The ongoing “forever chemical”lawsuit involving Logan Paul and KSI’s Prime has resulted in a request for them to pay $5,000,000 in damages, but the court has not yet issued an official order.
A lawsuit against Prime, filed in August 2023, alleges that the grape hydration flavor contains an unsafe level of per- and polyfluoralkyl substances, commonly referred to as “forever chemicals.”
According to the US Environmental Protection Agency, these chemicals have been linked to reproductive and developmental problems, as well as an elevated risk of cancer and other health issues.
In April 2024, an update regarding the case gained widespread attention on social media, leading co-owner Logan Paul to address the accusations against Prime for being harmful.
YouTube stars Logan Paul & KSI ended their infamous rivalry to start their very own beverage company in 2022.
The latest update in the ongoing lawsuit states that the plaintiff is requesting a minimum of $5,000,000 in compensation for the alleged hazardous presence of forever chemicals. According to the filing, the plaintiff’s damages expert will use a price-premium theory and/or full disgorgement to calculate the amount that the plaintiff was overcharged. The details can be found in the document.
“Plaintiff and the putative class have asserted damages in excess of $5,000,000.00, not including interests and costs. The precise calculation of damages will be revealed in accordance with the Court’s scheduling order and the Federal Rules of Civil Procedure.”
Prime refuted the plaintiff’s request for damages, contending that the statements in question were “unsubstantiated.”
“According to the defendants, the plaintiff has not provided any evidence to support her claims for damages or other forms of relief. They argue that the statements made by the plaintiff are baseless and unsubstantiated. Furthermore, the defendants assert that the plaintiff received what she had agreed to and has no valid grounds for seeking any form of relief.”
As of writing, the plaintiff has only requested an order for damages and the judge has not yet made a decision. The hearing to determine this matter is scheduled for May 16, 2024.
Even with this lawsuit, Prime Hydration continues to be a popular choice among consumers, surpassing Gatorade as the top-selling sports drink in March 2024 and flying off the shelves at retailers.
