Logan Paul & KSI’s Prime Hydration Accused of Breaching Contract in $68M Lawsuit

Logan Paul and KSI are facing a $68,000,000 lawsuit for breach of contract from a bottling company over their company, Prime Hydration. The bottling company claims that Prime backed out of a previously agreed upon deal.

The lawsuit, which was filed on August 2, 2024, stated that the agreement between Prime and Refresco Beverages required the company to invest significant amounts of money in modifying its production line in order to manufacture the unique bottles used by the brand led by influencers.

As a result of the significant investment in the production line, it is believed that the two companies reached a mutual agreement regarding a minimum order commitment. Failure to meet the agreed-upon orders from Refresco would have obligated Prime to pay a predetermined amount of money per case.

The paragraph states that if Defendants fail to purchase and receive 90% of the specified annual volume for each of the three contract years, they will be required to pay Refresco a predetermined amount for every 12-bottle case that falls short of the volume commitment.

As reported by BloombergLaw in the lawsuit shared by BloombergLaw, Refresco had been preparing to conduct a trial of the popular beverage when Prime unexpectedly withdrew from the agreement entirely.

Refresco is claiming that Prime breached the contract and is seeking $67,710,000 in damages. They are also requesting interest, bringing the total amount to over $68M.

Prime is currently facing a growing number of legal challenges, and this lawsuit is just one among many that the influencer-led drink company is currently dealing with.

In 2023, a woman brought a lawsuit against Prime, alleging that its grape-flavored hydration drink contained “forever chemicals”that are believed to be linked to cancer and other health problems.

In May 2024, a group of individuals filed a class action lawsuit against Prime for allegedly engaging in “false advertising”on its energy drink cans. The plaintiffs alleged that the drink contained over 200mg of caffeine.

As soon as Prime signed Kevin Durant as a sponsored athlete, the company released a limited edition bottle featuring the NBA star’s branding. However, the US Olympic Committee quickly filed a trademark infringement lawsuit against Prime for including Durant’s Olympic achievements on the back of the bottle.
