Min Hee Jin Discusses Unprecedented Injunction Dismissal: ‘Even Lawyers Acknowledged No Precedent for This Lawsuit…’

On the 29th afternoon, Min Hee Jin made a guest appearance on the YouTube channel, Kim Young Dae’s School of Music, where she shared her thoughts on the recent judicial developments.

Earlier that same day, the Seoul Central District Court’s 50th Civil Division rejected Min Hee Jin’s provisional injunction, which she had filed on the 13th of the previous month against HYBE for the enforcement of voting rights.

A dismissal indicates the conclusion of a case without a formal ruling, typically because the lawsuit fails to meet legal standards or the stipulations established by law.

In explaining their decision, the court remarked, “Despite HYBE’s direction for the board to vote for Min Hee Jin’s CEO appointment, the board members must exercise their duty of care in making a decision. It cannot be construed that they are legally bound to comply with HYBE’s directives. Consequently, granting the injunction would yield no legal consequences, rendering the provisional application without merit and thus inappropriate.”

In response to the ruling, Min Hee Jin participated in a live broadcast, stating, “This isn’t solely about right versus wrong, and even achieving a win would have been challenging. The legal intricacies can sometimes feel like mere technicalities. I previously secured a provisional injunction that upheld the shareholder agreement, yet I find myself in a quandary regarding whether HYBE and ADOR are truly one entity.” She further asserted, “My motivation for filing the injunction stemmed from a desire to affirm my integrity and innocence. I felt compelled to pursue this route until all options were exhausted. Contrary to HYBE’s assertions, my intent was never to walk away.”

Min Hee Jin went on to add, “I was also intrigued about whether this would be successful. Even my legal counsel noted the absence of precedents for this type of lawsuit, estimating my likelihood of success as only 10-20%. From my standpoint, this was an opportunity for HYBE to reconsider. Since I found it difficult to relent, I wondered if stepping down in this manner might allow my pride to accept the outcome.”

Meanwhile, a board meeting is scheduled for the afternoon of the 30th to deliberate on Min Hee Jin’s reappointment as CEO of ADOR.
