Hanni’s Visa Situation Amidst NewJeans Contract Termination
Recent developments surrounding Hanni, a member of the popular group NewJeans, have raised questions about her visa status as the expiration of her E-6 visa approaches. This visa, essential for foreign entertainers to perform in South Korea, is crucial for Hanni, who holds dual Australian-Vietnamese citizenship. In contrast, her groupmates possess either Korean nationality or dual citizenship, allowing them to work in Korea without visa complications.
Termination of Contract with ADOR
On November 28, 2023, NewJeans conducted a press conference announcing the termination of their exclusive contract with ADOR. Given that the E-6 visa is linked to specific employment, the dissolution of the contract implies Hanni’s visa could also become invalid. According to regulations, individuals must report workplace changes within 15 days or establish a new employment contract to maintain valid visa status.
As of the date of this report, it has been over 15 days since the contract termination was announced. If the termination became effective as claimed, Hanni’s visa is rendered invalid starting November 29.
Current Visa Usage and ADOR’s Position
Despite this, Hanni has continued to perform under the visa issued through ADOR, leading to a complex situation in which she appears to be utilizing a visa from an agency with which she claims to no longer be affiliated. This raises potential legal ambiguities concerning the status of her contract with ADOR.
ADOR has commented that Hanni’s visa is set to expire in the upcoming year and asserts that the contract remains valid. They are reportedly preparing to submit necessary documents to extend her visa, which could support their argument that the exclusive contract still holds.
The Challenges of Securing a New Visa
Seeking a new E-6 visa presents its own set of challenges. Applicants must submit multiple documents, including an exclusive contract with a registered agency and letters of support from both the inviting agency and the Ministry of Culture, Sports, and Tourism. This process typically spans two to three months, complicating Hanni’s situation further.
Adding to the complexity is NewJeans’ busy schedule, which includes high-profile events such as the SBS Gayo Daejeon on December 25 and the 2024 Asia Artist Awards on December 27. Navigating visa processes during this packed lineup without an official agency could prove daunting.
Legal Considerations and Future Implications
For the time being, labeling Hanni as an illegal resident may be premature. ADOR’s ongoing legal action to affirm the legitimacy of her contract may influence immigration authorities to regard the visa as valid until a definitive court ruling is issued.
Meanwhile, NewJeans has been proactive in rebranding, launching a social media presence under a new identity, “NewJeanz,”as they navigate their evolving status. The next steps they take regarding Hanni’s visa situation have become the focal point of public interest.
