NASCAR driver Caesar Bacarella has filed a lawsuit against Logan Paul & KSI’s Prime Hydration for allegedly violating the trademarks of his supplement company, Alpha Prime.
Ever since its debut in 2022, Prime Hydration, founded by Logan Paul and KSI, has gained immense popularity and is now recognized as one of the leading beverage companies globally.
On July 30, 2024, Caesar Bacarella, a NASCAR Xfinity driver, filed a lawsuit against the brand for trademark infringement. However, the lawsuit is not related to his racing career.
On the other hand, Bacarella asserts that Prime Hydration violates the trademarks of his Alpha Prime supplement company.
According to the lawsuit, this case concerns federal trademark infringement (specifically forward and reverse confusion) and unfair competition under the Lanham Act, as well as Florida state law trademark infringement of Bacarella’s ALPHA PRIME trademarks.
“As stated in further detail below, Defendant’s utilization of PRIME and its variations falsely imply a connection with Bacarella, and are easily mistaken for Bacarella’s existing marks, ALPHA PRIME and PRIME BITES. Despite the fact that ‘PRIME’ has only been in circulation for a brief period, there have been numerous instances of genuine confusion found.”
The outcome of having these products that are confusingly similar is not only real, but it also creates a high possibility of confusion regarding the source of the products. This negatively impacts the reputation and goodwill of Bacarella’s brand.
Bacarella is requesting that the judge order Prime Hydration to cease distribution of their “confusingly similar”products, which likely includes both Hydration and Energy drinks, due to the trademark infringement.
In 2024, Prime Hydration has faced multiple trademark infringement lawsuits, including one in July when they collaborated with Kevin Durant and were sued by the US Olympic & Paralympic committee.
Prime’s collaboration with Durant is targeting its biggest rival Gatorade.
Prime included mentions of Durant’s previous involvement with the Olympics and his past gold medal wins on the bottle.
On August 2, 2024, a $68M lawsuit was filed against them for breach of contract. It was claimed that they had failed to fulfill an agreement with their bottler, Refresco.
