Tenant faces lawsuit after paying rent to wrong person for 13 months

An unfortunate tenant is facing the possibility of a lawsuit after mistakenly paying rent to the wrong person for 13 months without realizing it.

Kody Lynn, known as ‘lizzywithaglizzy’ on her TikTok account, shared with her followers the story of how she ended up with an angry landlord who believed she owed $18,508 in rent.

For over a year, Kody had been utilizing Venmo to send all her rent payments, including her security deposit. However, she recently discovered that her landlord had not received any of the payments.

During the span of 13 months, the person whom Kody had been sending money to had never mentioned the regular payments they were receiving, and her landlord only just recently realized that no rent had been received during that time.

Tenant pays over $18,000 rent to wrong person

Despite not having met the owner beforehand, Kody made arrangements for her apartment payments through the property manager. However, she stated that she accidentally entered one incorrect letter on Venmo when sending her first deposit and two weeks’ worth of rent.

Despite regularly sending money to the same Venmo account and being given the keys to her place, Kody’s actions went unnoticed until her property manager informed her that a recent check had “bounced”, indicating that something was amiss.

Upon realizing the situation, Kody immediately turned to Venmo and submitted a request for a complete refund of her missing funds. The individual who had mistakenly received her rent payment then reached out to her to address the mistake.

Kody clarified that the man’s story was that his deceased relatives had some connection to the payments, but she pointed out that her own payments had a detailed explanation and she was skeptical of his explanation.

He proceeded to inform Kody that his sister, who was a heroin addict, had taken the money. She did offer to pay it back in installments, but her landlord was not willing to wait.

Despite having provided an explanation of the situation and offering to pay six months’ worth of lost rent in advance, with the remainder to be paid later, Kody was given a strict ultimatum to send the full amount within 60 days or face eviction.

Fuming with anger and deeply offended by the proposal, Kody consulted a lawyer before informing her landlord of her decision to vacate the premises. She also proposed to pay the rent in installments once it was refunded to her. Despite the offer, the landlord was dissatisfied and proceeded with a legal action.

“I’m not afraid of a lawsuit, I’m currently in law school. We can take this to court, but it won’t lead to a good outcome for either of us,”Kody confidently stated. “Plus, I have legal representation now – my dad, who happens to be an attorney.”

She continued, stating that she would prefer to avoid getting sued and having to go to court. She then jokingly added that the lawsuit would serve as beneficial practice for her future career.

Despite Kody’s acceptance of the possibility of going to court with her landlord, viewers remained unconvinced that the entire situation was not a complex scam.

One person suggested that the ‘wrong person’ could potentially be a relative of his. They also added that any landlord would surely realize if they were not collecting rent from a tenant, and that the situation seemed suspicious.

One person also shared the sentiment, saying, “I have a feeling they were trying to scam you. How could they have not verified the security deposit before allowing you to move in?”

“Had the property manager or owner not received your deposit and first month’s rent, they would not have given you the keys.”
