NZXT, in collaboration with its billing partner Fragile Inc., has reached a preliminary settlement of $3.45 million. This resolution addresses a class-action lawsuit concerning the company’s Flex PC rental program.
This settlement was made public on April 7, 2026, following extensive scrutiny of the program’s marketing practices and contract terms, which allegedly misled consumers. The lawsuit was filed under the Racketeer Influenced and Corrupt Organizations Act (RICO) and was resolved prior to going to trial.
Approximately 20, 000 individuals are part of this class action, and relief is anticipated to commence pending final court approval, which is scheduled for September.
Key Aspects of the Settlement: Debt Forgiveness, Hardware Claims, and Cash Payments
The issue surrounding this settlement traces back to 2024 when Gamers Nexus conducted a comprehensive investigation into NZXT’s Flex program, labeling it as “aggressive” and “predatory.” The findings from their reporting played a pivotal role in court proceedings.
The plaintiffs contended that the Flex program was marketed as a rent-to-own option, even though the contracts functioned more like indefinite leases. Moreover, the complaint highlighted instances where customers received hardware different from what was promised, with swapped components while maintaining the same pricing. It also accused Fragile Inc.of employing overly aggressive collection tactics, including attempts to recover debts already settled.
As outlined in the court documents, the $3.45 million settlement will be allocated to 19, 322 eligible customers who participated in the program between October 19, 2023, and March 30, 2026. The distribution is structured as follows:
- A debt forgiveness fund totaling $923, 117.92, allowing for up to $5, 000 per individual who is more than 90 days overdue.
- A hardware ownership fund of $1.21 million for customers who have participated in the program for a minimum of two years and can submit claims asserting they believed it operated on a rent-to-own basis.
- Cash payouts for former customers who returned their PCs and have no outstanding debts, with estimates of payouts ranging between $450 to $500, subject to the overall number of claims received.
Eligible participants can expect to receive notifications once the official claim portal is activated. According to legal documents, the settlement website and contact information should be made available within 21 days after April 7, which suggests a potential launch around April 28.
